The facts are these:
Some drivers don't understand and will often try and allege you were at fault. This includes witnesses who are also car drivers who can be bias in their opinion of what's happened.
Some insurers don't get it and will often just accept liability and potentially prejudice your case. Don't let them push you in to accepting anything.
Avoid admitting liability at the scene or thereafter. Seek legal advice first!
Take as many steps as possible to build your case because you may be up for a fight. Follow this advice and you put yourself in the best position for winning your case:
"If it's safe, and you are able to, the below are steps you can take. The most important factor is you health and safety, so make sure your health is prioritised and only engage in these further advisory steps if you are able to and it is safe to do so!"
If anyone is injured or any immediate disputes ensue, dial 999 and ask for the police and paramedics if necessary.
Exchange full details with the other parties involved.
Take photos showing the position of vehicles and any skid marks or debris on the road.
Take details of witnesses who may be able to verify your version of events.
Look around for CCTV cameras in the nearby area. Note their positions as they may have recorded the accident on camera.
If you couldn't get any or all of the above done at the scene, go back and do it or get a friend to help.
Seek medical attention immediately.
Prepare a sketch plan of what has happened, including directions of travel.
Write down your version of events so it's fresh in your mind and well documented.
Get in touch with us as soon as possible for advice. We are able to advise you on the initial call whether you have a case or not and we will always fight for your claim on a Genuine No Win, No Fee basis.
We will request CCTV evidence if applicable which is important to do sooner rather than later as most places will only keep footage for a few short weeks. You don't want to be in the nightmare situation of losing your only piece of evidence for your case!
