Being able to claim often comes down to the origin of the spillage and how it has happened. If it is caused by a person not in any capacity of work or industry (like a person who spills domestic paint on a road when crossing it) then it can be hard to claim. Your claim would be against them as an individual, and most people do not have personal insurance or funds to settle a claim with. If they were a professionally employed painter and it happened in the capacity of their employment, their employer could be held vicariously liable and you could claim that way.

When it comes to spillages from vehicles, it may not matter if it originates from a personal vehicle used for domestic and pleasure usages. Vehicles are supposed to be insured, so a case could go against the insurer of the vehicle or driver. If they are uninsured then your claim could be pursued through the Motor Insurers’ Bureau who can cover uninsured drivers.

What if you cannot trace the origin of the spillage?

It can be hard to claim for spillage accidents where the origin cannot be traced, but it is not necessarily impossible. You could be eligible to pursue a case using the Motor Insurers’ Bureau Untraced Driver Scheme, but this does hinge on a few key qualifying factors.

One is that you normally must at least prove that the spillage originated from an untraced driver. After all, it could have been from a person, which does not usually meet the criteria for an MIB claim.
