A motorbike accident from an obstruction in the road can be a serious one. As we always say, given the lack of protection a motorcycle offers when compared to a car, riders are at a higher risk of harm from serious injuries from any road accident they’re involved in.

If a biker hits an obstruction in the road and is injured as a result, they may have a claim for personal injury compensation. Depending on how the obstruction has come to be on the carriageway can depend on whether there is a valid claim to make.

Here is a little advice about this kind of scenario.

An obstruction on the carriageway can be a real danger for a biker. Whether it’s a trailer that has become detached from a vehicle, or a tyre or bumper or any other dangerous debris on the highway, it could be an accident waiting to happen for a rider.

Whether a biker can make a compensation claim will come down to how the obstruction occurred. If it’s a trailer form a wagon, you could pursue the insurers of the driver of the wagon. If it’s a part of a car that has come off, you could pursue the insurer of the car.

On the other hand, if it’s a fallen tree, you may have a hard time trying to get any money out of ‘Mother Nature’, unfortunately.

Where the obstruction has been caused because of a defect or some form of negligence on the part of another person or an organisation, you may be able to successfully claim. If they have insurance or finances, you have a potential avenue to be able to pursue damages with the possibility of recovering something.

Where there is no negligence, or an obstruction is caused by an uninsured person, it could be hard to settle a case.
