We can give you some general guidance in this article, but there are several elements of valuing a case as we will explain here. We can look at the legal guidelines for the injury alone, known as General Damages, but there can be a lot more to it than that.

For what the legal precedents view as minor back injuries, the compensation values are usually based on the length of the recovery. Generally speaking, the more you suffer, the more a case can be worth.
According to the official legal guidelines that we use, a motorcycle back injury case where a full recovery is made within around three months could be worth up £2,150.00. If the injury is worse and the recovery extends to two years, a case can be valued at around £7,000.00. Where a full recovery is achieved within five years, claim pay-outs can be in the region of up to £11,000.00.
When it comes to more severe back injuries, the compensation amounts can, of course, be far greater.
According to the guidelines:
We have given you the information from the official guidelines, but how much is your motorcycle back injury case worth?
The only way that we can know for sure is to properly pursue a personal injury compensation claim for you. Where you may fit into the guidelines can depend on the factors individual for your case, and we use a combination of our expertise and independent medical evidence to work this out. We can arrange for a private appointment with a suitable expert who will create the report for us to be used as the key piece of evidence for your case. Once you have signed off the report, we can then disclose it to the other side with the view to settling the case.
For back injury claims we will normally instruct an orthopaedic expert, but we may need additional experts for more serious injuries and non-muscular injuries. Any scarring or nerve damage, for example, may require a report from a plastic surgeon.
We have looked at legal precedents for valuing a motorcycle back injury case based solely on the injuries alone. When you make a claim for compensation, you can also recover damages for losses and expenses, and this can form an additional part of the case.
In serious injury cases, the losses and expenses part of the case – known as Special Damages – can be the larger proportion of the claim. If you can no longer work ever again due to your injury, you may be entitled to receive lost earning for the rest of your life. In theory, this could equate to hundreds of thousands of pounds or even millions.
