A motorbike accident caused by a bus can be an easy thing to happen, and it can be incredibly devastating for the injured rider. Bikers are allowed to weave between traffic which will normally be proceeding in a fairly standard way, but buses are different given that they’re going to be pulling in and out of bus lanes, bus stops and stopping generally for pick-ups and drop-offs.

On top of that, buses are big, and bikers tend to be far smaller in size, and therefore more difficult to see, and far harder to see in the blind spots of the buses. These factors can make a motorbike accident caused by a bus somewhat of an accident waiting to happen, but bikers have rights if they are injured by a bus.

Not that I’m directly stating this as a fact or accusing bus drivers of anything in particularly, but driving a bus all day can be tiresome and monotonous. It can be this as a factor that may cause a bus driver to ‘switch off’ – just a little. When you combine this with an overtaking biker, or a legally traffic-weaving motorcycle, it could be an accident waiting to happen.

Ultimately, the blame will lie on the party that has failed to pay due care and attention to the situation of the accident. If a bus driver pulls out of a bus stop or moves away from the curb and hits an overtaking biker, the bus driver will likely be liable, and the correctly proceeding biker should be eligible to make a claim for personal injury compensation. In another similar scenario, a bus driver must take care when changing lanes into, our out of, bus lanes. Many inner-city areas have bus lanes now, so the change of lane manoeuvre must only be conducted when it is safe to do so.

Who do you claim against when a bus driver is at fault?

The bus company, as their employer, should be the one insured to take responsibly for the claim. It’s wise to contact us as soon as you can so we can contact the bus company and safeguard any CCTV footage they may have which could prove vital to the claim. The bus company’s insurance should deal with the claim and hopefully pay the compensation you are owed.
