While jaw injuries are perhaps not the first injury we imagine when it comes to motorbike accidents, motorcyclists can be highly vulnerable in a road accident and can, therefore, be subject to many different types of injuries. It may not seem as common as a leg or arm injury, for example, but we believe that no motorcyclists should undervalue such injuries, as they may be entitled to make jaw injury claims where this kind of harm has been caused. And the damage could be extensive.

Generally speaking, each injury claim is unique, varying in severity and, therefore, in compensation value. This is why it is important to instruct expert injury lawyers when making your motorbike injury claim. Our thorough knowledge of case law and injury claims guidelines allows us to seek the maximum compensation amount possible for our clients, so contact us for advice if you think you might have a claim to make.

Making a motorbike injury claim

In a motorbike injury claim, it is always vital to establish that the other party involved in the accident is responsible for the accident due to their, perhaps, careless or reckless driving. If this cannot be established, you may not have a claim to make. However, you do not have to be completely innocent of any blame – you can still be eligible to claim even if you are partially responsible for the accident occurring, but your compensation may be reduced in some way. For example, if you are deemed to be 20% responsible for an accident, you may see a 20% reduction in the value of your final pay-out.

There is a long-established division of the damages in injury claims, which is where they are separated into General Damages and Special Damages. General Damages can account for the injury itself, covering the pain, suffering and loss of amenity caused. Special Damages can cover any losses or expenses which may have been incurred. For example, if you have lost earnings due to time off work, or if you need private treatment to help with your injury, we may be able to recover these costs as part of your claim.

Jaw injury claims

The varying values of jaw injury claims are set out by the Judicial College guidelines. This is the official guidance that we follow when evaluating our clients’ claims.

The compensation brackets for jaw injury claims are as follows:

Fractures of the Jaw

  • Very serious multiple fractures followed by prolonged treatment and permanent consequences, including severe pain, restriction in eating, paraesthesia and/or the risk of arthritis in the joints- £24,300 to £36,310.
  • Serious fracture with permanent consequences such as difficulty in opening the mouth or with eating or where there is paraesthesia in the area of the jaw- £14,320 to £24,300.
  • Simple fracture requiring immobilisation but from which recovery is complete- £5,150 to £6,960.

These guidelines highlight just how debilitating jaw injuries can be, particularly in cases where the pain is severe and has long-term complications.
