You’d think that with the advancements in technology – like Automatic Number Plate Recognition (ANPR) – uninsured drivers would be a thing of the past.

They’re still out there though!

So, if you’re a motorcyclist and you’re hit by an uninsured driver, or you’re in an accident that was not your fault and was caused by an uninsured driver, what can you do? Can you still make a claim for motorbike accident compensation? If so, how?

Hit by an uninsured driver – how do you still claim?

You can still claim if you’re hit by an uninsured driver. The claim is normally submitted to the Motor Insurers’ Bureau who can investigate claims and pay compensation to victims of uninsured drivers.

The Motor Insurers’ Bureau (MIB) are a not-for-profit organisation who have an agreement with the government to pay compensation to victims of uninsured and untraced drivers. A small part of the money we pay in insurance premiums funds them, and they can pay compensation as if they are the insurer themselves.

How does an uninsured driver claim with the Motor Insurers’ Bureau work?

It’s practically the same as if you had a claim against an insured-person. Your lawyer can submit a Claim Notification Form to the MIB and they can either point you in the direction of a potential insurer, or sort of act as if they are the insurer themselves.

They can then accept liability or defend the claim accordingly.

Other than the MIB being allowed more time for dealing with cases, it works in almost the same way as a case involving an insured-driver.

Will I qualify for a Motor Insurers’ Bureau uninsured driver case?

If you were not at fault for the accident, and the uninsured driver was, you should be eligible to claim.

In terms of liability, the claim should work in the same way as any other case. If the uninsured driver was at fault for the accident, you can claim for personal injury compensation and out-of-pocket expenses.

Will I receive less compensation?

No – the idea behind the scheme is to ensure you receive compensation based on the injuries and losses in exactly the same way as a case against an insurer. You are not penalised because it was an uninsured driver at fault, and the value of the claim should simply be based on the severity of your injuries and the amount of losses and expenses incurred.
