Foot injury claims for motorcyclists

Leg and ankle injury

As vulnerable road users, motorcyclists can be more susceptible to injuries when they are involved in accidents, among which foot injuries can be included. The severity of a foot injury can vary from person to person, sometimes impairing mobility slightly or, in the worst cases, it can result in the amputation of one or both feet. In cases where the other party in the accident is responsible, those who have suffered injuries such as these may be able to make foot injury claims for compensation.

Motorcyclists often encounter misconceptions and prejudices against them, as other drivers can wrongfully regard them as more dangerous or reckless road users. We want to make sure that car drivers cannot fall back on these excuses in the event of an accident, so you can be confident that we will fight your corner to win the compensation you deserve. Our specialist team can offer free, no-obligation advice to anyone who thinks they may have an injury claim to make.

Foot injuries and their implications

Any injuries to feet can provoke questions about the long-term mobility of the injured person. Fractures, chronic pain, arthritis, and amputation are just some of the possible results of an injury to your foot. In some cases, it may be possible to treat the injury and the injured person may experience some recovery, but in other cases there may be little that doctors can do to lessen the damage.

As a result, foot injury claims may need to account for the long-term management of the injury caused.

Compensation amounts in foot injury claims

In any injury claim, we can look to recover General Damages and Special Damages for our client where both are applicable. The first category covers the pain, suffering and loss of amenity caused by the injury itself, while the second category covers the financial costs and expenses that have resulted from the accident.

In the General Damages category, the compensation pay-outs for foot injury claims vary according to recommendations set out by the Judicial College guidelines, which we summarise below.

  • Amputation of both feet: £135,030 to £160,600.
  • Amputation of one foot: £66,930 to £87,410.
  • Very severe foot injury (permanent, severe pain or serious permanent disability): £66,930 to £87,410.
  • Severe foot injury (fractures of both feet, substantial restriction on mobility, or considerable/permanent pain): £33,460 to £55,830.
  • Serious foot injury (prolonged treatment, arthritis, continuing pain or risk of fusion surgery): £19,920 to £31,250.
  • Moderate foot injury (fractures resulting in permanent deformity and continuing symptoms): £10,960 to £19,920.
  • Modest foot injury (various kinds of fracture, ligament damage and wounds): up to £10,960.

The list above does not detail the full extent of the guidelines, but it can give you an idea of the compensation you could be entitled to when claiming for General Damages. Moreover, Special Damages could cover the cost of factors such as time taken off work, private treatment, travel to appointments, and mobility aids, as just a few examples.

It is also important to highlight that you may be able to claim even if you were partially responsible for the accident, though your compensation pay-out may be reduced. For example, if you were judged to be 20% responsible for the accident, you could expect a 20% reduction from your pay-out.
