It is that time of the year when many people may need to claim compensation as an injured biker as a result of being hit by a drunk driver. Whilst the warnings are clear, and the dangers are obvious, it is still the case that people decide to get behind the wheel of a vehicle when they have had too much to drink. Sadly, this happens a lot over the Christmas period.
As we have said many times before, there is simply no excuse for drink driving. If you have been injured as a biker by a drink driver, you are fully entitled to pursue them for compensation via their insurance company. Whilst many insurance companies have terms and conditions to void policies in certain scenarios, it is not common that they will be able to void a policy and refuse to compensate an accident victim if the policy holder was under the influence of alcohol. If it is the case that a driver is uninsured, you can still be entitled to pursue a claim, as there are mechanisms in place to allow uninsured riders to still claim.
The worsening weather is, of course, another factor this time of the year, where the dangers can be increased for riders as visibility is reduced, and bikers can be harder to spot. Drivers need to do all they can to take extra care to look out for other road users, and bikers need to take extra care to account for the fact that some other road users may fail to do so.
As with drink driving, the weather is no excuse. If a driver is negligent in the duty of care that they have for a biker, and they cause an accident and injuries, the rider is fully entitled to pursue a claim for compensation.
