According to the official guidelines: for very severe brain damage, you could be eligible to claim between £224,800 and £322,060. This bracket includes people with little, if any, evidence of meaningful response to their environment; little or no language function; double incontinence; and the need for full-​time nursing care. It can also include some ability to follow basic commands.

Moderately severe brain damage can include where the injured person is very seriously disabled. There may be substantial dependence on others, as well as a need for constant professional care and/or care from relatives. Disabilities may be physical and may include limb paralysis or cognitive problems, with marked impairment of intellect and personality. If your injuries fall into this bracket, you could be eligible to claim between £174,620 and £224,800.

In the moderate brain damage category, you could be eligible to claim between £72,300 and £119,650. This category includes the same injuries as moderately severe but where the degree of dependence is markedly lower.

In the cases of less severe brain damage, this can be where the injured person may have made a good recovery and may still be able to take part in normal social life and return to work. There may not have been a full restoration of all normal functions so there may still be persisting problems such as poor concentration and memory or disinhibition of mood, and this may interfere with lifestyle, leisure activities and future work prospects. Victims could be eligible to claim between £12,210 and £34,330.

Please note that the information above is sourced from the official guidelines. Further, these are just amounts for the injuries alone. In cases like this, the larger proportion of the claim can be made up of Special Damages, such as lost earnings for life, where applicable.
