What the official guidelines say

The official guidelines we can use for a motorbike shoulder injury claim are quite wide as they need to cover a broad range of bases.

For what we may refer to as minor, simple soft tissue injuries to the shoulder where a complete recovery is achieved, there are the following common brackets to refer to:

• Simple soft tissue injuries with recovery in up to three months: up to around £2,000.00;
• Soft tissue injuries where recovery is achieved within a year: up to around £4,000.00;
• Where recovery is complete but takes longer, up to around two years: up to around £7,000.00.

The next bracket deals with what are referred to as moderate shoulder injury claims. This may include where there are some minimal symptoms after the two-year period, or a frozen shoulder with limitation and discomfort within two years. This can lead to awards in the region of around £11,200.00.

The next two brackets are then for the serious and severe injuries. It is hard to fully place yourself in either category without the specialist medical evidence referred to above, but these are what the guidelines say:

• Dislocation, damage to part of the brachial plexus, sensory symptoms, weakness in grip and strength, fractures, rotator cuff injuries with persistent symptoms, likely requirement for surgery: up to around £17,000.00;
• Severe injuries where there may be damage to the brachial plexus that leads to significant disability, or severe symptoms that could radiate into the arm and elbow in the above category but more severe: up to around £42,000.00.

Remember: the above is just for the injury compensation alone. If the injury and the problems that you suffer with are severe, and this caused you to have a great deal of time off work, you could also claim lost earnings. If you are unable to work for two years and you only receive SSP, you could claim the difference between the SSP and your usual earnings as part of a personal injury case.
